1. Acceptance of Terms

By accessing, browsing, or using the TailoredMarketData platform ("TMD", "the Platform", "the Service", "we", "us", or "our"), you ("User", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must immediately discontinue use of the Platform.

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction.

If using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You are responsible for ensuring compliance with all laws applicable to you in your jurisdiction.

3. Description of Service

TailoredMarketData is a financial market data aggregation and visualization platform providing access to:

Real-time and historical stock, ETF, and cryptocurrency price data.

Technical analysis indicators and charting tools.

Institutional and congressional trading data.

Earnings reports, corporate actions, and macroeconomic indicators.

Custom watchlists, symbol groups, and saved chart layouts.

Subscription-based access tiers with varying feature sets.

The Platform aggregates data from multiple third-party sources. We do not guarantee the completeness, accuracy, or timeliness of any data provided.

4. No Investment Advice Disclaimer

THE PLATFORM IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. TAILOREDMARKETDATA DOES NOT PROVIDE FINANCIAL, INVESTMENT, LEGAL, TAX, OR TRADING ADVICE OF ANY KIND.

Nothing on the Platform constitutes a recommendation, solicitation, or offer to buy or sell any security, financial instrument, or cryptocurrency.

You are solely responsible for your own investment decisions. Consult a qualified financial advisor before making any investment decisions.

Past performance does not guarantee future results. All investments carry risk, including potential loss of principal.

Congressional and insider trading data is provided for informational transparency and does not constitute a recommendation to replicate any trades.

TailoredMarketData shall not be held liable for any losses arising from reliance on information provided through the Platform.

5. Account Registration and Security

You must provide accurate and complete information when creating an account.

You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

Notify us immediately of any unauthorized use at support@tailoredmarketdata.com.

We reserve the right to suspend or terminate your account for violations of these Terms.

You may not create multiple accounts or share credentials.

Account deletion is permanent and removes all your personal data and user-generated content.

6. Subscription Plans and Payments

6.1 Free Plan

The Platform offers a Free plan that provides access to a limited set of features at no cost and with no credit card required.

The Free plan is designed to allow you to evaluate the Platform and its capabilities before committing to a paid subscription.

We strongly encourage all users to fully explore the Platform using the Free plan before subscribing to any paid plan.

We reserve the right to modify the features and limitations of the Free plan at any time without notice.

6.2 Paid Plans

Paid subscription tiers (Standard, Pro, and Enterprise) provide access to additional features and higher usage limits.

Paid subscriptions are billed on a recurring basis (monthly or yearly) via PayPal.

All subscriptions automatically renew unless cancelled before the renewal date.

Upgrades: Prorated charges apply immediately. Upgraded features become available immediately.

Downgrades: Take effect at the next billing cycle. No refunds or credits for the price difference.

6.3 Cancellation

You may cancel your paid subscription at any time, either from your account billing settings on the Platform or directly through your PayPal account.

When you cancel, your subscription will not renew and no further charges will be made for any subsequent billing period.

You will retain full access to your paid plan features until the end of the billing period you have already paid for, after which your account automatically reverts to the Free plan.

Cancellation stops future renewals only. It does not entitle you to a refund or proration for the current or any prior billing period (see Section 6.4, No Refund Policy).

6.4 No Refund Policy

ALL SUBSCRIPTION FEES ARE STRICTLY NON-REFUNDABLE. ONCE A PAYMENT IS PROCESSED, NO REFUNDS WILL BE ISSUED UNDER ANY CIRCUMSTANCES, INCLUDING CANCELLATION, DOWNGRADE, DISSATISFACTION, OR FAILURE TO USE THE PLATFORM.

By subscribing to a paid plan, you acknowledge that you have had the opportunity to evaluate the Platform through the Free plan and that your decision to purchase a paid subscription is made with full knowledge of the Platform's capabilities and limitations. This no-refund policy applies to all subscription fees, including monthly, yearly, and prorated upgrade charges.

7. Acceptable Use Policy

You agree not to:

Use the Platform for any unlawful purpose.

Attempt to gain unauthorized access to any portion of the Platform or other users' accounts.

Use automated means (bots, scrapers, crawlers) to access or collect data without written permission.

Redistribute, resell, or commercially exploit any data from the Platform.

Interfere with or disrupt the Platform, servers, or networks.

Reverse-engineer, decompile, or disassemble any part of the Platform.

Circumvent security features or subscription-level restrictions.

Use data from the Platform to manipulate markets or engage in market abuse.

8. Intellectual Property

The Platform and all proprietary content are owned by TailoredMarketData and protected by intellectual property laws.

Your subscription grants a limited, non-exclusive, non-transferable, revocable license for personal use.

User-generated content (watchlists, groups, layouts) remains your property. You grant us a license to store and display it as needed to provide the Service.

9. Data Accuracy and Third-Party Dependencies

THE PLATFORM RELIES ENTIRELY ON THIRD-PARTY DATA PROVIDERS FOR ALL MARKET DATA AND CHARTING FUNCTIONALITY. WE DO NOT GENERATE, INDEPENDENTLY VERIFY, OR GUARANTEE ANY DATA OR SERVICES DISPLAYED ON THE PLATFORM.

All market data is sourced from third-party providers. Accuracy, completeness, and availability depend entirely on these external providers.

The Platform uses the TradingView Advanced Chart library solely for charting and data visualization purposes. All market data displayed on the Platform is sourced and provided independently by TailoredMarketData through its own data feeds; we do not use TradingView's data feed services. TradingView is a registered trademark of TradingView, Inc. Your interaction with the charting widget may be subject to TradingView's own terms and conditions. We are not affiliated with, endorsed by, or sponsored by TradingView, Inc.

Real-time data may experience delays, interruptions, or inaccuracies due to provider outages, API changes, rate limits, or network conditions.

If a third-party provider (including but not limited to TradingView or any data feed provider) modifies, restricts, or discontinues their service, the affected features may become unavailable, degraded, or discontinued. In such cases, we will use commercially reasonable efforts to find alternative solutions or replacement providers, but we do not guarantee that equivalent functionality or data will be available.

We do not guarantee uninterrupted, error-free access to the Platform.

If third-party changes force us to modify or discontinue features, no refunds will be issued for fees already paid.

Charts on the Platform are rendered using the TradingView Charting Library, a third-party charting tool provided under license. Use of this charting tool does not mean the data displayed originates from, is endorsed by, or matches the TradingView website (tradingview.com) or any other TradingView-branded product or service.

Price, OHLC (open/high/low/close), volume, timestamps, and other market data shown on our charts may differ from the data shown on the TradingView website or other third-party platforms. Such differences may result from different data feeds and sources, data adjustments, symbol mapping, exchange and session settings, time-zone handling, aggregation methods, and timing, and do not constitute an error or defect in the Service.

Technical indicators and other analytics are calculated independently by our own systems and may differ from indicators of the same name shown on the TradingView website or other platforms, due to differences in calculation formulas, parameters, default settings, input data, and rounding. You should not expect exact parity between our charts, indicators, or values and those of any other service, and you rely on any such data at your own risk.

10. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, DATA, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL TAILOREDMARKETDATA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR FINANCIAL LOSSES FROM TRADING DECISIONS BASED ON PLATFORM DATA.

In any case, the maximum total amount we may be held liable for shall not exceed the total subscription fees you have actually paid to us during the twelve (12) months immediately before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless TailoredMarketData from claims arising from your use of the Platform, violation of these Terms, or investment decisions made based on Platform data.

13. Termination

We may suspend or terminate your account at any time for violations of these Terms.

You may terminate your account at any time through the Platform's settings.

No refunds will be issued upon termination, whether initiated by you or by us, except where required by applicable law.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within ninety (90) days, it shall be submitted to binding arbitration or the competent courts of the jurisdiction determined at the time of filing.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by posting a notice on the Platform. Continued use constitutes acceptance of the revised Terms.
